20-10-2016 Heard Sri D.N.Tiwari, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Kartaha P.S. Case No. 48 of 2016 registered for offence under Section 7 of the Essential Commodities Act, 1955 and Sections 419, 420, 120(B), 34 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner was simply an employee of Sanjana Rice Mill and he was not directly involved in committing black-marketing. He submits that the owner of the rice mill has not been arrested. Learned Addl. Public Prosecutor opposed the prayer for bail and he submits that earlier, case diary was called for and as per facts disclosed in the case diary, the petitioner is not entitled

Patna High Court Cr.Misc. No.40603 of 2016 (3) dt.20-10-2016 2/2 to be enlarged on bail.

However, keeping in view the fact that petitioner is not owner of the rice mill, he can be extended the privilege of bail. Let the petitioner namely Tinku Kumar Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - Vth, Vaishali, Hajipur in connection with Kartaha P.S. Case No. 48 of 2016.
