The petitioner prays for grant of bail in Rivilganj P.S. Case No. 75 of 2016, registered under Sections 272, 273 of IPC and Sections 47 (a) of the Bihar Excise Amendment Act 2016.
A search was conducted near the house of co-accused Ramdev Mahto. Two persons assembled at the place managed to flee away and three were arrested. It is stated that no recovery of country made liquor was made from his possession. Petitioner is in custody since 29.04.2016. Co-accused Sheru Khan who was similarly caught while making attempt to flee away like the petitioner has been granted bail by this court vide order dated 26.7.2016 (Annexure-2).
Considering the facts and circumstances of the case, the petitioners, above, named is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 7th, Saran, Chapra in Rivilganj P.S.
Patna High Court Cr.Misc. No.48438 of 2016 (2) dt.26-11-2016 2/2 Case No. 75 of 2016, subject to the following conditions: (i) One of the bailors shall be the own/close family members of the petitioner.
(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the court below. In case of default in doing so on two consecutives occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
