The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 406, 414 & 120B of the Indian Penal Code.

Acting on a tip-off, when the informant along with the police force arrived at the kiosk of SBI of Agriculture Branch, the petitioner was apprehended and on search ATM cards of different banks, cash of Rs.15,000/- and other papers are said to have been recovered from possession of the petitioner.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. While the

No.38052 of 2020(3) dt.05-03-2021 2/2 petitioner was passing through the place of occurrence at the time of occurrence, the police had stopped him and due to hot exchange of words, the police has falsely been implicated the petitioner by planting the alleged recovery on a concocted story. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecedent and has been languishing in custody since 01.07.2020.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Laheri P.S. Case No.239 of 2020.
