The petitioner apprehends his arrest in Rajiv Nagar P.S. Case No. 259 of 2015, registered for the offences punishable under Sections 451 and 379 of the Indian Penal Code. The informant alleged that the petitioner who is son of his landlord entered into his house and committed theft of money, ATM card and other documents. The wife of the informant saw the petitioner coming out from her room.
Learned counsel for the petitioner submits that the petitioner is admittedly son of the landlord of the informant. There is a dispute with regard to payment of rent and that is why the son of the landlord has falsely been implicated in the case. The purse was recovered from inside the premises but nobody has seen the
Patna High Court Cr.Misc. No.46878 of 2016 (3) dt.23-03-2017 2/2 petitioner committing theft.
Considering the facts aforesaid and the facts that the wife of the informant also saw the petitioner coming out from that room from where money and other articles of the informant were found missing and there is no document to show that the informant had any altercation with the landlord with regard to payment of rent, I am not inclined to enlarge the petitioner above named on anticipatory bail.
