6/10 CORAM: HONOURABLE MR. JUSTICE BIBEK CHAUDHURI ORAL JUDGMENT Date : 03-07-2024
1. The petitioners appeared in the recruitment process of existing 1132 vacant posts of Court Reader-cumDeposition Writer on probation, initially for a period of two years in the Civil Courts of Bihar.
2. For recruitment on such posts, an advertisement was published being Employment Notice No. 03 of 2022 by the Convener, Centralized Selection and Appointment Committeecum- District and Sessions Judge, Patna on 13th of September 2022. Clause 8 of the said advertisement notice states the procedure of selection. The procedure is quoted below: - "8. Procedure of selection: - The recruitment process shall comprise of three stages Preliminary Written Test and Interview.
A. Preliminary Test The committee may organize preliminary test on the basis of multiple-choice objective questions for screening the candidates, depending upon the number of candidates applying for the post.
B. Written Test (90 Marks) The written test shall comprise of descriptive and objective type questions.
C. Interview (10 Marks) Syllabus of Written Test The written test shall consist of the following
7/10 subject: - A. English Language and Grammar (20 marks) :
- Letter Writing, Essay, Precis, Comprehension and Vocabulary. B. Hindi Language and Grammar (20 marks):

D. Mathematics of matriculation standard (10 marks): - The test shall comprise questions on topics viz. BODMAS, Simple Calculations, Problem based on Time and Distance, Time and Work, Calculation of Simple / Compound Interest, Ration and Proportion.
E. Test of Reasoning (Verbal and Analytical type) (10 marks):- Problems based on English alphabets, Sitting arrangement, Blood relationship, Circular Sitting arrangement, Analogy, Ranking test, Syllogism, Problems based on Venn-diagram.
F. Basic Computer Science (15 marks) : - History of Computers, Fundamentals of Computer and terminologies, Computer abbreviations, Basis of Hardware and Software, Keyboard shortcuts, Operating systems basics, Basic Functionalities of MS-Office (Word, Excel and Power-Point), Internet terms and services, Networking and communication, Security Tools and Viruses.
The Minimum qualifying marks will be 40% in the written examination. The category wise cut-off marks shall
8/10 be decided by the Committee in accordance with reservation policy, existing rules and number of vacancies. The Preliminary examination shall comprise of Multiple-Choice Objective questions based upon the syllabus/subjects provided for written examination. There shall be skill test along with the Main (Written) Examination in the following manner: Sl. No.
Skill Marks Computer Typing Test in English Computer Typing Test in Hindi The Speed / Proficiency of the candidate shall be tested on the criteria as laid down in Schedule 'A' of the Rules, which is provided as Typing Speed 40 wpm in English and 30 wpm in Hindi.
Minimum Qualifying Standard in the skill test: (i) 90% accuracy in English Typing (ii) 90% accuracy in Hindi Typing The marks obtained in the preliminary examination by the candidates, who are declared qualified for admission to the Main (Written) Examination, will not be counted for determining their final order of merit.
The marks obtained in the interview will be added to the marks obtained in the Main (Written) Examination and candidates' position in the merit list will depend upon the aggregate of both."
3. The grievance of the petitioners is that date was fixed for holding skill test by way of Computer Typing etc. on 9th, 10th and 14th of May, 2024. It was found by some candidates, who are petitioners before this Court, that the Computer System
9/10 was found to be inoperative or there were some glitches/technical difficulties in the computers through which the petitioners were directed to give the skill test. The candidates immediately during the examination and after examination before publication of result submitted representations to the Convener of the examination. However, by one line order, the applications filed by the petitioners were rejected by the Convener of examination without considering their grievances on merits.

It is submitted by the learned Advocate appearing on behalf of the Convener, Centralized Selection and Appointment Committee-cum-District and Sessions Judge, Patna that only 23 representations have been received by the Convener and those applications were duly considered and rejected. Final result has been published. Therefore, no case should be held to be made out by the petitioners other than the said 23 candidates.
5. Be that as it may, the Convener, Centralized Selection and Appointment Committee-cum-District and Sessions Judge, Civil Courts, Patna is directed to dispose of all the representations considering the merits thereof individually in respect of candidates who actually filed representations and for
10/10 the purpose of proper consideration of the representations, the Convener is at liberty to look at the CCTV footage of the examination halls on the dates of skill test. The representations should be decided on merits within a period of two weeks from the date of receipt / communication of a copy of this order.
6. The Respondent No. 3 - Convener, Centralized Selection and Appointment Committee-cum-District and Sessions Judge, Civil Courts, Patna is at liberty to examine the eligible petitioners also if the disposal of the application filed by the candidates do warrant.
7. With the aforesaid observation / direction, this petition stands disposed of.
