JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The prosecution case is that co accused Anil Sah being employee of the informant eloped with the minor daughter of the informant along with seventy thousand rupees. It is alleged against the petitioner that he facilitated the elopement. It is submitted by the learned counsel for the petitioner that the thrust of accusation is against Anil Sah and the petitioner has been roped in the present case since he happens to be one of the friends of Anil Sah. It is further submitted that the victim girl has filed an affidavit (Annexure 2) before the learned court below

Patna High Court Cr.Misc. No.34336 of 2015 (2) dt.25-08-2015 2/2 that she was in love with Anil Sah and has married with him and co accused Arvind Sah has been granted anticipatory bail vide Cr. Misc. No. 30858 of 2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, (West) Muzaffarpur in connection with Kanti P.S. Case No.192 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
