JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Kankarbagh P.S. Case No. 358 of 2014, registered under Sections 304(B) and 328/34 of the Indian Penal Code. Learned counsel for the petitioner submits that admittedly the petitioner is the husband of the deceased, daughter of the informant. The petitioner performed love marriage with the deceased in a temple. It would also appear from the F.I.R. that on the alleged date of occurrence, this petitioner had gone to his Sasural, house of the informant, where petitioner and his wife (deceased) after taking dinner slept in the room, but petitioner was not apprehended by the informant and

In fact, due to love marriage of the petitioner with the deceased daughter of the informant her Mayaka people was annoyed and due to that reason, poison was administered to her in her Mayka and with ulterior motive, the petitioner has falsely been implicated in this case with false allegation. While the prayer for bail of the petitioner was rejected on 01.10.2015, but this fact was not brought in the notice of the Court. The petitioner is in custody since 23.08.2014.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-IX, Patna in connection with Kankar Bagh P.S. Case No. 358 of 2014.
