The petitioner seeks bail in connection with Suryagarh P.S. Case No. 225 of 2020 dated 30.11.2020 instituted for the offences under Sections 396 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner has not been named in the F.I.R. His complicity in this case has surfaced on the confessional statement of one Bhupendra Singh. Except for the confession of aforesaid Bhupendra Singh, there is no other material to connect the petitioner with the offence.

The petitioner is in custody since 03.12.2020 and does not any other criminal antecedents to his credit.

No.54142 of 2021(2) dt.26-05-2022 2/2 In similar circumstance, one accused person of this case namely Fantush Kumar @ Fultush Kumar has been granted bail by a coordinate Bench of this Court vide order dated 20.01.2022 passed in Cr. Misc. No. 35986 of 2021. Mr. Singh, learned counsel has pointed out that though the charges have been framed in this case but, the trial actually has not commenced and no witness has been examined as yet.

Considering the aforenoted submissions and taking into account the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Suryagarha P.S. Case No. 225 of 2020.
