Petitioner prays for bail in connection with Phulwari Sharif (Janipur) P.S.Case No. 642 of 2017 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Allegation as per FIR is that motorcycle of brother of informant slightly dashed the body of one Baishakhi Manjhi and for that scuffle took place between petitioner and others and deceased and his friends and friends of deceased fled away and informed the informant, who is brother of deceased, and later on dead body was found in the river.
Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case merely on
Patna High Court Cr.Misc. No.47187 of 2018 (3) dt.20-09-2018 2/2 suspicion and nobody had seen the occurrence and there is general and omnibus allegation and petitioner is in custody since 9.10.2017.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-IV, Patna, in connection with Phulwari Sharif (Janipur) P.S.Case No. 642 of 2017, corresponding to Sessions Trial No. 408 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
