2. The petitioner has preferred this application for grant of regular bail in connection with Railway Station (RS) P.S. Case No. 12 of 2024 dated 17.03.2024 registered for the offences punishable u/ss 21(b) of the N.D.P.S. Act.
3. As per the prosecution case, Rs. 1,00,390/- was recovered from the house of the petitioner and Rs. 3,03,000/- along with 60 gm smack was recovered from the co-accused, Sohrab. The petitioner also disclosed that the recovered money from her was given to her by the co-accused, Sohrab which also belonged to the business of smack.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.43305 of 2024(2) dt.02-07-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has surfaced in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the seized contraband is less than the commercial quantity. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is a lady and she is in custody since 18.03.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Araria in connection with Railway Station (RS) P.S. Case No. 12 of 2024.
7. The application stands allowed.
