Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 419, 420/34 of the Indian Penal Code.
The prosecution case is that the petitioner and three others set up another candidate for appearing at the physical test for the recruitment in the Home Guard. It is submitted by learned counsel for the petitioners that none was apprehended at the time of medical test and only on suspicion the accusation has been levelled. Moreover similarly situated co-accused has been granted anticipatory bail vide Cr. Misc. No. 25074 of 2015. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.37239 of 2015 (2) dt.14-09-2015 2/2 petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S. Case No. 107 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
