JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-09-2016 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner namely Banti, son of Meharban Singh is in custody in Phulwarisharif P.S. Case No.313 of 2016 under Sections 399, 402 of the Indian Penal Code and 25(1-b)a/26/35 of the Arms Act.

According to the informant, the accused persons assembled and preparing for commission of dacoity. They were chased and from the possession of one Banti(co-accused and not the petitioner), one country made pistol and one live cartridge has been recovered. So far the present petitioner is concerned, although, his name is Banti, his father's name is Meharban Singh and the possession of this petitioner, nothing has been recovered.

No.38980 of 2016 (2) dt.17-09-2016 In view of the above facts and circumstances of the case and nature of allegation, I direct that the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of Ms. Shema Earm, Judicial Magistrate 1st Class, Patna in connection with Phulwarisharif P.S. Case No.313 of 2016.
