The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 324, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the informant's brother and the Canteen Staff Vivek Kumar of MGM Nursing Home were assaulted by the petitioner and Security Guard Shivlal Singh and Kamlesh Kumar. Subsequently Shivlal Singh and Kamlesh Kumar resorted to fire but it did not cause any injury to anyone. It is submitted by learned counsel for the petitioner that mobile of the Nursing staff was stolen for which
Patna High Court Cr.Misc. No.36019 of 2015 (2) dt.21-08-2015 2/2 the informant was interrogated, hence, with the malicious accusation the present case has been lodged when no injury was caused to anyone.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Kadam Kuan P.S. Case No. 218 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
