The petitioner, already in custody, seeks bail in connection with S.T.No. 179 of 2001 arising out of Pandaul P.S.Case No. 149 of 2000 registered under Sections 302/34 of the Indian penal Code.

Allegation in brief is that two unknown persons called the informant's son from her home and later on she learnt that some persons of another village killed her son and raised suspicion against FIR named accused persons.

Submission is that petitioner is not named in the FIR and it's a case of the year 2000 and after 18 years of investigation charge sheet has been submitted against the petitioner and name of the petitioner transpiring so late as after thought and the motive for committing occurrence, as per the investigation

Patna High Court Cr.Misc. No.24823 of 2018(4) dt.03-08-2018 2/2 report, is the deceased having illicit affair with one Sunita Devi, wife of Sunil Choudhary and the petitioner is not related with them.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Shyam Sundar Choudhary @ Shyam Sundra Choudhary is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge-VII, Madhubani in connection with S.T. No. 179 of 2001 arising out of Pandaul P.S. Case No. 149 of 2000.
