JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 175, 409 and 420 of the Indian Penal Code. Allegation against petitioner is that he had not submitted the papers/documents relating to appointment of panchayat teachers of the Panchayat concerned which he had received from his predecessor.
It has been submitted on behalf of petitioner that he is in custody since 14.9.2016. Chargesheet has been submitted against petitioner. There is no allegation of tampering of witnesses against petitioner. Petitioner has got no criminal antecedent. Petitioner has been made accused due to mistake of fact. Whatever papers he had received in respect to appointment of panchayat teacher from his predecessor, he has already deposited the same. No appointments are said to have been made at the time when petitioner was posted as Panchayat Secretary of the concerned Panchayat.
On behalf of the State, it is submitted that petitioner is
Patna High Court Cr.Misc. No.50235 of 2016 (3) dt.15-12-2016 2/2 named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Cass, Dehri, in connection with Rohtas (Amjhor) P.S. Case no. 44 of 2016 , G. R. no. 246 of 2016.
