The petitioner seeks bail in Bihta P. S. Case No. 46 of 2019 instituted for the offence under Section(s) 387 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
In the written report, it is alleged that on the date of occurrence two persons came on motorcycle and made firing upon informant. The informant has alleged that such occurrence had taken place on the direction of one Ujjwal Kumar who had earlier threatened the informant and made demand of Rs. Five lakhs as ransom for which the informant had earlier lodged Bihta P.S. case no. 40 of 2019 dated 11.2.2019.The name of this petitioner has come during investigation in the confessional
Patna High Court CR. MISC. No.38543 of 2019(2) dt.28-06-2019 2/2 statement of co-accused Chiku Kumar. Co-accused Chiku Kumar has already been granted bail by co-ordinate Bench of this Court by order dated 13.5.2019 passed in Cr. Misc. no. 29349 of 2019.
Petitioner is in custody since 2.2.2019.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-1st Danapur, Patna in connection with Bihta P. S. Case No. 46 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
