22-11-2016 Heard Sri Pramod Kumar Pandey, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody in Sessions Trial No. 284 of 2016, arising out of Sugauli (Bettiah) G.R.P. (Rail) P.S. Case No. 37 of 2015 registered for offence under Sections 395, 397 of the Indian Penal Code.

It was submitted by learned counsel for the petitioner that F.I.R. was lodged against unknown and petitioner is vendor on the railway platform and he has falsely been implicated. He further submits that save and except confessional statement of one of the co-accused, there is no other material to connect the petitioner. Neither any recovery was effected from the petitioner nor the petitioner was put on T.I.Parade. He further submits that in

Patna High Court Cr.Misc. No.29199 of 2016 (6) dt.22-11-2016 2/2 similar circumstances, number of accused persons have been extended the privilege of bail, by order dated 24-05-2016 coaccused Basuki Nath Paswan was granted bail, vide Cr. Misc. No. 22349 of 2016, by order dated 13-05-2016 co-accused Chandan Kumar Singh was granted bail, vide Cr. Misc. No. 20342 of 2016, besides other accused persons.

Keeping in view the fact that most of the accused persons, almost in similar circumstances, have already been extended the privilege of bail as well as the fact that nothing was recovered from the petitioner nor the petitioner was put on T.I. Parade, there is no reason to further detain the petitioner. Let the petitioner namely Ravi Ranjan Kumar Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Addl. District & Sessions Judge, Bettiah, West Champaran in connection with Sugauli (Bettiah) G.R.P. (Rail) P.S. Case No. 37 of 2015, with condition that (i) one of the bailor must be blood relation of the petitioner and (ii) the petitioner shall render full cooperation during the trial. (Rakesh Kumar, J.)
