JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 14.9.2017 passed in Cr.Misc.No.39080 of 2017 and allegation against the petitioner is of committing rape upon the informant.

Submission of learned counsel for the petitioner is that similarly situated co-accused has been granted bail vide order dated 19.2.2018 passed in Cr.Misc.No. 5069 of 2018. Heard learned APP also.

Since the case is rape and the girl has supported the allegation in her statement under Section 164 Cr.P.C., I am not inclined to grant bail to the petitioner.

I am not satisfied with the report submitted by Superintendent of Police, Bhojpur, Ara at Flag 'B'. He is directed

Patna High Court Cr.Misc. No.26212 of 2018 (4) dt.25-07-2018 2/2 to produce the witnesses in court on the date fixed positively so that trial may be expedited, otherwise Superintendent of Police will face the consequence.
