JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-07-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Section 364(A), 34 of the Indian Penal Code.

It is a case of kidnapping of the informant and demanding ransom amount of Rs. 20 lakhs by all the F.I.R named accused persons including the petitioner. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Patna High Court CR. MISC. No.41755 of 2023(2) dt.21-07-2023 2/2 has not paid any ransom demand to anyone. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner is languishing in custody since 22.07.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Moreover, other similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 22.05.2023 passed in Cr. Misc. No. 23472 of 2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XI, Patna in connection with Patna Hawai Adda P.S. Case No. 184 of 2022.
