Petitioner is in jail custody since 15.6.2016 in a case registered under sections 342, 363, 366, 376, 386, 114 and 120B of the Indian Penal Code as well as sections 3, 4, 5, 6, 7 and 9 of the Immoral Traffic Act.
Statements of all the three victims have been recorded under section 164 Cr.P.C in which except one victim , none of the victim has made any complain against the petitioner and one victim, namely, Suman Kumari has stated that the petitioner had also persuaded her to indulge herself in flesh trade. However, the aforesaid victim admitted that she has been residing in the house of the petitioner since last 15 years. So, entire allegation of running brothel appears to have centered around against husband of the petitioner.
Considering the aforesaid facts and circumstances as well as
Patna High Court Cr.Misc. No.38870 of 2016 (4) dt.30-09-2016 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Sadar P.S. Case no. 506/2016.
