Petitioner seeks bail in connection with Bihta P.S. Case No. 40 of 2019 registered for the offence punishable under sections 448, 341, 387, 504, 506/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been implicated in this case on basis of confessional statement of the co-accused. Nothing has been recovered from the conscious possession of this petitioner. Similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 10.07.2019

Patna High Court CR. MISC. No.38990 of 2019(3) dt.04-09-2019 2/2 passed in Cr. Misc. No. 42565 of 2019. Learned counsel has produced the web copy of the aforesaid order. Let it be kept on record. Petitioner is in custody since 02.02.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, I, Danapur, Patna in connection with Bihta P.S.
