2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 85, 126(2), 115(2), 303(2), 352, 351(2), 351(3) and 3(5) of the B.N.S..

3. As per prosecution case, informant alleged that this petitioner came and forcibly put vermilion on forehead of informant and made physical relations with her. It is further alleged that on 25.12.2025, this petitioner and his wife entered into room of informant, abused her, assaulted her and snatched her mobile phone and Mangalsutra.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, petitioner is a 67 years old land lord and informant is a tenant in the house of this petitioner and due to landlord tenant dispute, this false and concocted case has been lodged. The present case is counterblast of Dalsingsarai P.S. Case No. 517 of 2025 which was lodged prior to lodging of the present F.I.R. by the wife of this petitioner against informant stating therein that she had rented out ground floor of her house to Kanchan Kumari and she herself resides on the first floor and second floor of the house is also rented.

She alleged that when this petitioner came from Bombay, he came to know about wrong people visiting the tenant Kanchan Kumari and thus, this petitioner installed C.C.T.V. cameras in the house and asked Kanchan Kumari to vacate the room and on 25.12.2025, Kanchan Kumari came to the first floor and demanded her mobile phone which was allegedly stolen by them and on protest, she assaulted this petitioner, his wife and his son and also snatched gold chain and fell down from the stairs while going down and in retaliation, and only with a view to save her skin from the aforesaid case, this false and concocted case has been lodged.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case and case and counter-case between the parties, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Dalsingasari, District- Samastipur in connection with Dalsingsarai P.S. Case No. 519 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
