2. The petitioner seeks bail in connection with Amdabad P.S. Case No. 42 of 1999 for the offences alleged under Section 7 of the Essential Commodities Act.
3. It is submitted that the petitioner was granted bail by the Court below in connection with an F.I.R. instituted in the year 1999. The petitioner could not appear before the learned trial court owing to flood and accordingly his bail bond was cancelled on 26.06.2014. It is stated that charge has been framed on 18.07.2016. The petitioner has since been taken into custody on 24.06.2016 and has remained in jail thereafter. The petitioner undertakes to remain present before the Court regularly and cooperate in disposal of the trial.
4. Having regard to the entirety of the facts and circumstances of the case and in the interest of justice, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate,
Patna High Court Cr.Misc. No.41433 of 2016 (2) dt.03-10-2016 Katihar, in connection with Amdabad P.S. Case No. 42 of 1999, with the following conditions:- (i) That one of the bailors will be a close relative of the petitioner.
(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.
(iii) That the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure to do so on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
