JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in a case registered under Sections 395 and 398 of the Indian Penal Code. As per prosecution case rupees eight lacs was looted in course of filling the money in ATM and indiscriminately resorted firing upon the informant, gun man and the driver of the Van. It is submitted by the learned counsel for the petitioner that the petitioner has committed no offence. Nothing has come in course of investigation indicating the complicity of the petitioner except confessional statement of Pintu Kumar and Amit Kumar Rai. It is further submitted that co-accused Amit Kumar Rai has been granted bail by a Coordinate Bench of this Court vide order

Patna High Court Cr.Misc. No.30986 of 2017 (2) dt.06-07-2017 2/2 dated 08.12.2016 in Cr. Misc. no. 47571 of 2016. The petitioner is languishing in custody since 21.04.2017.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- IV, Samastipur, District- Samastipur in connection with Mohiuddinagar P.S.Case No. 102 of 2016. (Prakash Chandra Jaiswal, J) singh/- U T
