JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,467,468,471 and 120B of the Indian Penal Code.
The prosecution case is that the petitioner filed a probate case on the basis of a forged will dated 27.12.2013 alleged to be executed by Pano Kunwar, the aunt of the informant on the basis of forged death certificate.
It is submitted by the learned counsel for the petitioner that in the probate case the informant has already entered appearance.
Considering the fact that the genuineness of the alleged will will be tested in the probate case, let the above named petitioner be released on anticipatory bail in the event of arrest or
Patna High Court Cr.Misc. No.35752 of 2015 (2) dt.04-09-2015 2/2 surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Kadirganj Town P.S. Case No.50 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
