2. The petitioner apprehends his arrest in connection with Singhiya P.S. Case No. 218 of 2024, registered for the offences punishable under Sections 137(2), 96, 3(5) of BNS.
3. As per allegation, the petitioner along with other co-accused persons kidnapped the minor daughter of the informant for the purpose of marriage.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. The victim did not support the prosecution case in her statement under Section 183 of the BNSS. She stated her age as 20 years. She has stated that she has solemnized marriage with the
Patna High Court CR. MISC. No.41448 of 2025(4) dt.04-12-2025 2/2 petitioner, as per her own sweet will. The victim and the petitioner are residing as husband and wife.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Rosera, Samastipur in connection with Singhiya P.S. Case No. 218 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
