JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-08-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 17.4.2017 passed in Cr.Misc.No. 17239 of 2017 and there is allegation against the petitioner is of assaulting the informant and forcibly marrying her with one Monu Kumar and also leaving her from the village.

Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case and he has remained in custody for about 18 months and he is ready to abide by any condition that may be imposed on him.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five

No.47013 of 2018 (3) dt.29-08-2018 2/2 thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I-cum-Special Judge, POCSO Act, Madhepura, in connection with Shankarpur P.S.Case No. 127 of 2016, corresponding to POCSO Case No. 3 of 2017(s), subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
