The petitioner seeks bail in Jankinagar P.S. Case No. 74 of 2017 instituted for the offence under Sections 394, 120B of the Indian Penal Code and Section 27 of the Arms Act. As per prosecution case, the son-in-law of the informant namely, Mukesh Kumar Bhagat, on the date of occurrence, proceeded with the truck from his house for Gulabbagh with two lacs cash to purchase Teena plate and when he reached near Gaushala Chowk, three persons from the motorcycle without registration number, intercepted the truck. The son-in-law of the informant Mukesh raised alarm then one person fired at Mukesh causing firearm injury to him and another
Patna High Court Cr.Misc. No.31274 of 2017 (2) dt.11-07-2017 2/2 miscreant looted away the bag with cash and fled away. The informant alleged that he has suspicion that driver of the truck namely, Pintu Yadav (petitioner) after hatching conspiracy with other co-accused person has committed occurrence.
From the impugned order also it appears that mere suspicion has been raised against this petitioner. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri D. Prakash, learned Judicial Magistrate, Purnea in connection with Jankinagar P.S. Case No. No. 74 of 2017 subject to the condition that both the bailors will be the close relatives of the petitioner.
