Petitioner seeks bail in Barauni P.S. Case No.486 of 2018 instituted for the offence under Section(s) 399, 402, 120-B Indian Penal Code and Section 25(1-B)A, 26, 35 of the Arms Act.

Counsel for the petitioner submits that Petitioner is in custody since 15.10.2018.

It is alleged in the written report that police arrested four persons on suspicion that they have assembled to commit crime and three persons managed to run away. It is alleged that one loaded country made pistol and four live cartridges were recovered from possession of the petitioner.

Patna High Court CR. MISC. No.38485 of 2019(2) dt.27-06-2019 2/2 accused, Kaushal Kumar, has already been granted regular bail by co-ordinate Bench of this Court by order dated 20.05.2019 passed in Cr. Misc. No.32857 of 2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Begusarai, in connection with Barauni P.S. Case No.486 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.

Further, (i) the petitioner will remain present on each and every date of trial, (ii) His absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled, and (iii) the petitioner will not intimidate the witnesses in any way and will not hamper the trial.
