====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 26-07-2023 Heard Mr. Pramod Kumar, learned counsel appearing on behalf of the petitioner and Mr. Binod Kumar, learned A.P.P. for the State.

2. Learned counsel appearing on behalf of the petitioner informs this Court that he has received instruction that due to strategic posting of the petitioner, who is in India Air Force, he could not carry on the direction of this Court contained in order dated 09.05.2023 passed in Criminal Miscellaneous No. 4811 of 2023. The petitioner is ready to surrender within three weeks and for this he has to seek leave from his controlling authority. In these background he seeks for extending the terms to surrender before the Court below.

3. Considering the aforesaid submission made on

Patna High Court CR. MISC. No.46150 of 2023(2) dt.26-07-2023 2/2 behalf of the petitioner, the petitioner may seek for leave along with a copy of this order from his Controlling Officer, Group Commander, Indian Air Force, Kasauli, Himanchal Pradesh and surrender within three weeks from the date of passing of this order. The order dated 09.05.2023 is accordingly modified to the above extent. The other part of the order shall remain intact.

4. Accordingly, the present modification application is disposed of.
