The petitioner being Branch Manager of Oriental Insurance Company Limited at Munger is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 504, 323, 506, 34 of the Indian Penal Code.
The prosecution case is that the informant purchased Alto K 10 car and got it insured through Oriental Insurance Company Limited. Subsequently the car of the informant met with an accident but the insurance claim was not paid to the informant and when the informant went to the office of the petitioner, he was being slapped by the office bearer of the petitioner and driven out from the office. No.39017 of 2015 (2) dt.01-10-2015 2/2 petitioner that even assuming the accusation, no offence is made out against the petitioner as the delay in reimbursement of the claim was made due to the various factors and now the claim has already been reimbursed. The documents to that effect have been brought on record as Annexures-2 and 3. Considering the nature of accusation and the fact that claim has been reimbursed, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 129 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
