JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2017 The petitioner seeks regular bail in connection with Matiyariya P.S. Case No. 26 of 2012, registered for offences punishable under Sections 341, 323, 307 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is of firing causing injury to him in his arm and chest.
It has been submitted on oath at para -7 of the petition by learned counsel for the petitioner that no injury has been caused to the informant on his chest. Further petitioner has been in judicial custody since 11.03.2017 and other co-accused persons have been granted bail by this Court vide order dated 26.10.2016 passed in Criminal Miscellaneous No. 38368 of 2016 and vide order dated 15.10.2015, passed in Criminal Miscellaneous No. 41675 of 2015. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, nature of allegation period of custody
Patna High Court Cr.Misc. No.26638 of 2017 (4) dt.11-07-2017 2/2 and also other co-accused persons have already been granted bail by this Court, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM- VIII, Bettiah, West Champaran, in connection with Matiyariya P.S. Case No. 26 of 2012, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of his bail bonds.
