JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363,366A,370,370A and 374/34 of the Indian Penal Code.

The prosecution case is that minor daughter of the informant namely Rina Kumari who was taken by co accused Chandri Rai to reach home but he ultimately sold her for rupees twenty thousand to the petitioner and co accused Guna Rai who kept her for a month in the house for the purpose of marriage. In 164 Cr.P.C. statement the victim got her age recorded as 12 years and the court assessed her age as such where she alleged specific overt act against the petitioner.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.34571 of 2015 (2) dt.01-09-2015 2/2 regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Majorganj P.S. Case No.18 of 2015 pending in the court of learned C.J.M. Sitamarhi. This application is disposed of with the aforesaid observation/direction.
