ANJANA MISHRA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. This is the third attempt by the petitioner renewing his prayer for bail. On the earlier two occasions, this Court had after due consideration of the matter rejected the prayer for bail of the petitioner.

The trial was to be concluded within a period of nine months after the order dated 2.12.2015. However, till date the trial has not been concluded and as per the report received from the trial court, six witnesses have already been examined and for the Doctor and two official witnesses, the trial could not have been concluded as on date.

However, considering all facts and circumstances of

Patna High Court Cr.Misc. No.44457 of 2016 (5) dt.08-02-2017 2/2 the case, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected. The trial court is, however, once again directed to proceed with the case on day to day basis and take necessary steps for examination of the rest of the witnesses, so that the trial of the present case is concluded positively by the 30th of June, 2017.
