ANJANA MISHRA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Tharthari P.S. Case No.57 of 2015 for the offence under Sections 406 and 420 of the I.P.C.

Learned counsel for the petitioner submits that there is accusation against the petitioner of defalcation of Rs.11,42,051.38. It is further submitted that out of the said amount he has already deposited an amount of Rs.1/- lac and receipt thereof has been annexed herewith as Annexure-7 to this petition. Learned counsel further submits that the petitioner is willing and ready to deposit 20% of the aforesaid amount within a

Patna High Court Cr.Misc. No.35782 of 2015 (2) dt.21-08-2015 2/2 period of 8 months.

Learned counsel for the BSFC has no objection to it and it is directed that from the amount so calculated, amount of Rs.1/- lac shall be adjusted, In view of the aforesaid offer made by the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the J.M., Nalanda, in Tharthari P.S.
