JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered for offence punishable under Sections 272, 273,308, 34 of the Indian Penal Code and Section 30(A), 37 (B), 41 (I) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 72 bottles (375 ml. each), 96 bottles (180 ml. each), 12 bottles (750 ml. each), 96 bottles (180 ml. each), 46 bottles (180 ml. each) and 24 bottles (375 ml. each) foreign liquor, Rs.21,000/- and a Nokia mobile were recovered from the possession of the petitioners. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Ex., Siwan in connection with Mairwa P.S. Case No.113 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
