JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-366(A)/34 of the Indian Penal Code. The statement of victim was recorded u/S 164 of the Cr.P.C. in which, she stated that she had left her home along with the petitioner No. 1 by her own volition. Although prior to making the aforesaid statement, she stated that the petitioner No. 1 took her without consent.

Considering the above-said contradictory statement of the victim as well as facts and circumstances of the case, let the petitioners named above, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.44671 of 2016 (2) dt.18-10-2016 2/2 bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Chiksaura P.S. Case No. 83 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda.
