1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Paliganj P.S. Case No. 252 of 2023 dated 12.05.2023 registered under Section 341 / 323 / 308 / 379 / 504 / 34 of the I.P.C.
3. As per the first information report on 12.05.2023 in the morning the petitioners arrived at the door of the informant and petitioner no. 3 assaulted with heated iron rod on the left hand and head of the informant. The petitioner no. 2 assaulted the family members of the informant on the head and petitioner no. 1 assaulted the informant's wife with iron rod causing burn injury.
4. Mr. Y.C. Verma, learned senior counsel for the petitioners
Patna High Court CR. MISC. No.40174 of 2025(2) dt.16-07-2025 2/2 submits that both the parties are closely related and the petitioner no. 1 & 2 are the own brothers of the informant and petitioner no. 3 is the son of petitioner no. 1. There is land dispute between the parties. Referring to injury report of the injured, learned counsel submits that injuries are not serious in nature therefore in the F.I.R. Section 308 I.P.C. has been added instead of Section 307 I.P.C.
5. Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are closely related having land dispute, as such, I am inclined to grant anticipatory bail to the petitioners.
6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Danapur in connection with Paliganj P.S. Case No. 252 of 2023 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
