JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It appears that the name of petitioner came in confessional statement of co-accused Anil Kumar and, after that, the house of the petitioner was raided and Gas Cylinder and L.E.D. T.V. of Samsung company were recovered from his house. Petitioner disclosed that the seized Gas Cylinder had been stolen by him from the house of Ramanand Singh. So far as seized L.E.D. T.V and some jewelleries are concerned, the same were identified by one Dinesh Kumar Mishra.

Admittedly, no stolen property of the present case has been recovered from conscious possession of the petitioner.

Patna High Court Cr.Misc. No.36846 of 2016 (2) dt.01-09-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate at Motihari in connection with Chhatauni P.S.Case No. 77 of 2016.
