The petitioner seeks bail in anticipation of his arrest in connection with Jamui P.S. Case No.143 of 2009 instituted for the offences under Sections 379/34 of the Indian Penal Code. The allegation against the petitioner is that liquid coal having been found below from the requisite quantity. The petitioner is being sought to be arrested.

Taking into consideration the nature of allegation, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest, he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sanjeev Prakash Sharma, J) amit/- U T
