Since there is no recovery from petitioner no. 4, his prayer for anticipatory bail is allowed.

Let petitioner no. 4, above-named, in the event of his arrest or surrender within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Mahesi P.S. Case No. 89 of 2014, which shall be abide by the terms and conditions mentioned in sub-section (2) of section 438 of the Code of Criminal Procedure.

Patna High Court Cr.Misc. No.38386 of 2014 (2) dt.13-03-2015 Anticipatory bail application of the petitioner nos. 1, 2 and 3 is hereby rejected in connection with Mahesi P.S. Case No. 89 of 2014 pending in the Court of Chief Judicial Magistrate, Saharsa.

Let the petitioner nos. 1, 2 and 3 surrender in the court below and pray for regular bail, which shall be considered on its own merit.
