JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-09-2015 Heard learned counsels for the petitioners and the State. The petitioners being unmarried sisters of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act. The accusation is of killing the daughter of the informant by throttling for non fulfillment of dowry demands. It is submitted by the learned counsel for the petitioners that the accusation is not specific and no date of marriage has been mentioned in the FIR. It is further submitted that the victim since had no issue, committed suicide and the informant retracted from the initial version and has filed a petition to that effect before the
Patna High Court Cr.Misc. No.34583 of 2015 (2) dt.01-09-2015 2/2 learned court below.
Considering the fact that the petitioners are unmarried girls and the informant retracted from the initial version, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class cum Addl. M-5, Bikramganj, Rohtas in connection with Karakat P.S. Case No.45 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
