JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-11-2021 The present writ petition has been filed seeking quashing of the order dated 12.10.2020 passed by the Sub- Divisional Officer, Sadar Madhubani, whereby and where under the PDS license of the shop of the petitioner bearing license No.28/2019 has been cancelled.
At the outset, the Ld. Counsel for the petitioner seeks liberty on behalf of the petitioner to file appropriate appeal before the appellate authority
Patna High Court CWJC No.1704 of 2021(2) dt.01-11-2021 2/2 as per the provision contained in Rule 32 (iii) of the Bihar Targeted PDS (Control) Order, 2016.
The Ld. Counsel for the Respondents State, Shri Alok Ranjan, AC to AAG-5 has got no objection. Accordingly, the present writ petition stands disposed of as not pressed, however, with liberty to the petitioner to file appropriate appeal against the impugned order dated 12.10.2020 before the appellate authority and in case such an appeal is filed within a period of four weeks from today, the appellate authority shall examine the same on merits and pass a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter.
