The petitioner seeks bail in connection with Samastipur Rail (G.R.P) P.S. Case No. 81 of 2016, registered under Sections 20, 22 and 23 of the N.D.P.S. Act, pending in the court of Sessions Judge, Samastipur.

Earlier, the prayer for bail of the petitioner was rejected vide order dated 20.04.2017 passed in Criminal Misc. No. 15061 of 2017 on merit.

The report, as called for, vide order dated 16.05.2018 has been received from the court of 1st Addl. Sessions Judge, Samastipur vide letter No. 218, dated 11.07.2018, which shows that after framing of the charge,

Patna High Court Cr.Misc. No.28391 of 2018(3) dt.25-07-2018 2/2 seven prosecution witnesses have been examined and the trial of this case shall be concluded very soon.

Having considered the facts and circumstances of the case, I am not inclined to reconsider the bail prayer of the petitioner. Accordingly, the prayer of the petitioner for grant of bail is again rejected. However, the learned Court below is directed to take all effective steps to conclude the trial of the petitioner within four months.
