Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 504, 307, 379 of the Indian Penal Code. Accusation against these petitioners is of entering into the shop of the informant and robbing golden chain and Rs.5,000/- kept in the shop and also assaulting to the informant. The accused persons also assaulted Bishwajit Sharma and Parmatma Sharma. It is further alleged that the Dharmendra
Patna High Court Cr.Misc. No.34546 of 2015 (2) dt.25-08-2015 Bin and Dudh Nath Bin took away Rs. 25,000/- from the shop counter of the informant.
It is submitted by the learned counsel for the petitioners that there is no injury report of the informant on record and injury of other persons are found to be simple in nature. Hence, no offence under Section 307 of the Indian Penal Code is made out. Moreover, the accusation of theft is alleged against petitioner nos. 5 and 7.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Siwan Muffasil P.S. Case No. 186 of 2015, pending in the court of learned Chief Judicial Magistrate, Siwan.
With this observation this application is disposed of.
