JUSTICE SUDHIR SINGH ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 25(1-b)a, 26, 35 of Arms Act.

It is alleged by the informant that there was a marriage ceremony at the house of the informant and Barat had come there, all of sudden this petitioner entered in the house of the informant. On that he raised alarm and informed the police. On arrival of police this petitioner was arrested and on search one country made pistol was seized.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.04.2016. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. One country

Patna High Court Cr.Misc. No.45841 of 2016 (2) dt.21-10-2016 2/2 made pistol is said to have been recovered from the possession of the petitioner. There is no compliance of Section 100 Cr.P.C. It has been submitted on behalf of the State that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Mirganj P.S.Case No. 106 of 2016.
