The petitioner seeks bail in connection with Aurai P.S. Case No.49 of 2016 registered under Sections 304(B), 201, 120(B)/34 of the Indian Penal Code.

Allegation in brief is that within two years of marriage, the petitioner is alleged to have killed his wife and disposed of the dead body on account of non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that this case was lodged after delay of two days and in fact, the petitioner's wife died of snake bite.

Learned counsel for the State submits that there is no medical prescription or any evidence to show that petitioner's wife

Patna High Court Cr.Misc. No.25881 of 2018 (4) dt.31-07-2018 2/2 died of a snake bite and within two years of marriage, she was done to death for non-fulfillment of demand of dowry and dead body was also disposed of.

Having considered the aforesaid facts and circumstances that the petitioner being the husband and the accusation is specific against him, so his prayer for bail is rejected for the present. The trial Court is directed to expedite the trial and preferably conclude the same within a year, if the trial is not concluded within the aforesaid period, the petitioner may renew the prayer of bail.
