JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Petitioner no. 1 is said to have given back portion of farsa blow to the informant causing injury on his head and so far as petitioner no. 2 is concerned, he is said to have given rod blow causing grievous injury on the hand of the injured, Ranjit Kumar. Annexure-4 series go to show that informant has not sustained any injury on his head and he only complained about abdominal pain, chest pain and headache and the doctor opined that aforesaid

Patna High Court Cr.Misc. No.39039 of 2016 (4) dt.27-09-2016 2/2 injuries were simple in nature. So far as injured, Ranjeet Kumar is concerned, he is said to have sustained one grievous injury on his hand. Moreover, there is case and counter case between the parties and persons from both sides sustained injury. The alleged occurrence appears to have taken place on account of land dispute. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Saharsa in connection with Bangaon P.S. Case No. 12 of 2016.
