Petitioners seek bail in a case registered under Sections 341, 342, 323, 384, 427, 379, 504/34 of Indian Penal Code.
It is submitted that though there are some cases from before against petitioners No 2, 3 and 4 but petitioner No 2 is on pre-arrest bail in the said case which is trivial in nature. Father of petitioners No 1, 2 and 4 are witnesses against one Umesh Yadav, Ex Mukhiya of Gram Panchayat, Guriya who is the master of the informant. It is also submitted that petitioner No 3 is the
Patna High Court Cr.Misc. No.29984 of 2017 (2) dt.06-07-2017 2/2 informant of the said case in which the father of other petitioners are witnesses. It is further submitted that from perusal of the first information report, it is quite obvious that even the allegation pertains to 06.07.2015, the information has been lodged on 17.07.2015 but the FIR does not disclose any reason for the delay whatsoever.
Considering the aforesaid submissions, prayer for bail is allowed. Let the petitioners above named be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Supaul in Jadia Police Station Case No 78 of 2015.
