JUSTICE KHATIM REZA ORAL ORDER 16-07-2025 Heard learned counsel for the petitioners; learned Additional Public Prosecutor for the State and learned counsel for the informant, who has appeared suo motu.

2. The petitioners apprehend arrest in connection with Konch PS Case No.186 of 2025 dated 16.03.2025, instituted under Sections 191(2), 290, 115(2), 126(2), 109, 352 of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioners is that on the alleged date of occurrence they along with other accused persons after forming unlawful assembly assaulted the informant and other on account of which they sustained head

Patna High Court CR. MISC. No.43562 of 2025(2) dt.16-07-2025 2/2 and bodily injuries.

4. Learned counsel for the petitioners submits that FIR has been lodged against nine accused persons including the petitioners. There is no specific allegation against the petitioners. Allegation against the petitioners is general and omnibus. It is further submitted that the allegation of assault is against other accused persons. There is case and counter case between the parties. Lastly, it is submitted that the petitioners have no criminal antecedents.

5. Learned APP as well as learned counsel for the informant has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, VIII, Gaya, in Konch PS Case No.186 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
